Terms Of Service	Aloha Pearls Inc. Terms of Service Thank you for you interest with Aloha Pearls and Welcome to Our Free Pearl Give Away! Please read the terms of agreement below. 1. Your Relationship with Aloha Pearls 1.1 The Universal Terms, together with the Additional Terms, form a legally binding agreement between you and Aloha Pearls Inc. in relation to our "Free Pearl Services". It is important that you take the time to read this document carefully. Collectively, this legal agreement is referred to below as the “Terms”. 2. Accepting the Terms 2.1 In order to successfully submit your application, you must firstly agree to the Terms. You may not receive services if you do not accept the Terms. 2.2 You can accept the Terms only by clicking the accept or agree to the Terms, where this option is made available to you by Aloha Pearls on this page. 3. Security of the Information You Provide 3.1 You acknowledge and agree that all information provided will be authorized for Aloha Pearls Inc internal use only. This means your data will be stored safely and will NOT be shared or sold with any other parties. 4. Services Provided 4.1 You acknowledge that the products shipped are real cultured freshwater pearl earrings. 4.2 You acknowledge and agree that Aloha Pearls is giving away free pearl earrings and as of August 20th 2008, you will be required to pay a fee of $3.50 that will cover shipping and packaging expenses. 4.3 You acknowledge and agree that Aloha Pearls may cancel your request to receive free pearls at any give time for any given reason due to but not limited to false information, incomplete addresses, fraudulent names, duplicate information, deleted weblinks. Any cancellation will result in a full refund. 5. Delivery of Goods 5.1 Processing of goods for shipping is made thirty days from your sign up date. On average you should receive the shipment in 6 to 8 weeks. Due to rare third party delivery issues you acknowledge delivery could take up to 5 months. Although Aloha Pearls will make every effort to ship in a timely fashion the company will not be held liable for internal or external problems that hinder expedition of the services described above. 5.2 Regarding the shipping, Aloha Pearls is not responsible for any false information provided. In the event you insert your address incorrectly Aloha Pearls is under no obligation to send a second shipment. You may however request a second shipment providing you cover the shipping and packaging expenses. 5.3 If you are a webmaster you agree to provide a link to our site that is visible for both search engine robots and visitors. You further agree that the link will remain available for at least 6 months while under your control. Exceptions to these terms include shut down of website, sale of the website and technical problems 5.4 You acknowledge that one 1 pair of pearl earrings will be shipped per household. Colors include black, pink, white, and peach. We cannot guarantee which color you'll receive. There are also two types of backings witch include rubber backings and metal backings. You acknowledge that the backings you receive could be either rubber or metal. Pearl shapes may vary. Shipping and handling charge of $3.50 is required. 6. Use of Goods 6.1 The goods received will be real cultured pearls. Their sizes may pose a threat to small children. Aloha Pearls will not be responsible for any misuse of the product between either adults or children. Misuse of product refers to but is not limited to an array of bodily harm such as ingestion, choking and even death. 7. Cancellation of this Agreement 7.1 In the event Aloha Pearls Inc. chooses to close this program you understand and agree that your free services maybe suspended or cancelled completely, and your money refunded if applicable.; By clicking on 'I accept' below you are agreeing to the Terms of Service Agreement Above.
